Rental Agreement

HOLIDAY HOUSE AND EXECUTIVE ACCOMODATION BOOKING TERMS AND CONDITIONS


These Terms and Conditions apply to lettings of holiday and Executive accommodation by John Michael McCullagh and Clare Alexis McCullagh of Rosedene Nurseries Limited Springboard Business Centre, Ellerbeck Way, Stokesley Business Park, Stokesley. TS9 5JZ (“Owner”). The Terms and Conditions form the basis of your contract with the Owner so please read them carefully before making a reservation.

  1. Definitions

“Booking Confirmation”

means the confirmation of booking provided to the Customer when a booking has been accepted;

“Booking Form”

means the online contact details form completed by the Customer;

“Customer”

means the person booking holiday accommodation;

“End Date”

means the last day of the Rental Period;

“Inventory”

means the inventory of fixtures furniture and effects at the Property a copy of which is kept at the Property;

“Property”

means the house (and garden, if any) identified in the Booking Form together with the fixtures furniture and effects specified in the Inventory;

“Rent”

means the rent specified in the Booking Form;

“Rental Period”

means the rental period specified in the Booking Form;

“Start Date”

means the first day of the Rental Period.

  1. Booking and Payment of Rent
    1. A booking is made by completing and submitting the Booking Form and paying the Rent
    2. The Customer must pay the Rent to the Owner when submitting the Booking Form.
    3. Once the Owner has received the Booking Form and the Rent the Owner will send the Customer a booking confirmation. At this point a binding contract exists.

The Owner agrees with the Customer:

  1. To pay all Council Tax in respect of the Property
  2. To pay to the relevant authorities all charges in relation to the supply of electricity, gas or water (including sewerage) services to the Property during the Rental Period and to pay all charges for the use of any telephone and broadband services at the Property during the Rental Period. The sums covered by this sub-clause include standing charges or other similar charges and Value Added Tax as well as any charges which may be made for actual consumption. This obligation is subject to the usage being fair and reasonable in all the circumstances. In the event that the actual usage is, in the Owners sole discretion (which must be exercised reasonably) deemed to in excess of a fair and reasonable level the Customer shall indemnify the Owner in respect of the excess.
  3. To pay the television licence fee in respect of any television set at the Property.
  4. In the case of non-holiday letting occupation only to provide a fortnightly housekeeping service including general and reasonable cleaning, and changing of linen and towels.
  5. That the Customer may quietly possess and enjoy the Property during the Rental Period without any interruption from the Owner or any person claiming under or in trust for the Owner.
  6. To return to the Customer any Rent payable for any period during which the Property has been made uninhabitable provided that the Property has not been made uninhabitable by the wilful destruction or negligence of the Customer.
  7. To repair the structure and exterior of the Property including drains, gutters and external pipes.
  8. Subject to the Customers obligations in clauses 4.1 to 4.3 inclusive, to repair and routinely maintain the interior of the Property
  9. To repair and maintain in working order the apparatus in the Property for the supply of water, gas and electricity and all sanitary apparatus and the central heating and hot water systems. All repairs must be carried out as soon as reasonably practicable.

  • Cancellation of Booking
    1. If the Customer cancels the booking the Owner shall be entitled to retain the Rent.
    2. If the Customer has not paid the Rent as specified Clause 2.2 the Customer will be deemed to have cancelled the booking under Clause 3.1.
    3. The Owner agrees that the Customer may quietly possess and enjoy the Property during the Rental Period without any interruption from the Owner or any person claiming under or in trust for the Owner.
    4. The Owner shall provide adequate bed linen and towels at the Property and pay all utilities and council tax.
